1. About These Terms

1.1 Who we are

BCKLE Ltd ("BCKLE", "we", "us", "our") is a company registered in England and Wales (Company Number 17098453). Our registered office address is available at Companies House. You can contact us at hello@bckle.app.

1.2 What these terms cover

These Terms of Service ("Terms") govern your use of:

By creating an account, subscribing to the Newsletter, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1.3 Other documents that apply

These Terms should be read alongside our Privacy Policy and Cookie Policy (bckle.app/cookies), which explain how we collect, use, and protect your personal data, including health data. Where there is any conflict between these Terms and our Privacy Policy regarding data processing, the Privacy Policy shall take precedence.

1.4 Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and/or in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may cancel your account before the effective date and receive a pro-rata refund for any unused subscription period.

1.5 Applicable law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or any other applicable legislation.

2. Eligibility and Accounts

2.1 Age requirement

The Service is intended for users aged 16 and over. By creating an account, you confirm that you are at least 16 years old. If we become aware that a user is under 16, we will immediately delete their account and all associated data.

2.2 Account creation

To use the App, you must create an account using either email and password or Google Single Sign-On. You agree to provide accurate and complete information during registration and to keep your account information up to date.

2.3 Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@bckle.app if you suspect any unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your account where such use was not caused by our negligence.

2.4 One account per person

Each account is for a single individual. You may not share your account credentials with others or create multiple accounts for the same person. We reserve the right to suspend accounts we reasonably believe are being shared or misused.

3. The Service -- What BCKLE Does and Does Not Do

3.1 What BCKLE provides

BCKLE is a performance intelligence platform for endurance athletes -- runners, cyclists, swimmers, and triathletes of all levels. The Service analyses data from your connected wearable device (currently Garmin, Oura, COROS, and Apple Health, with additional devices planned) to provide:

BCKLE is a wellness and informational tool. It is not a medical device, not a clinical diagnostic tool, and not a substitute for professional medical, nutritional, or coaching advice.

Specifically:

You should always consult a qualified healthcare professional before making decisions about your health, training, nutrition, or medical care. If you experience chest pain, persistent unexplained symptoms, or any medical emergency, seek immediate medical attention -- do not rely on BCKLE.

BCKLE's AI-powered features use large language models (currently provided by Anthropic) to generate responses. We want you to understand how this works:

We aim to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will endeavour to provide advance notice of planned maintenance where practicable.

4. Beta Programme

4.1 Beta access

If you are participating in the BCKLE beta programme, the following additional terms apply:

4.2 Founding member pricing

Beta participants who transition to a paid subscription will be offered a founding member rate of 7 per month, which is guaranteed for 12 months from the date of your first paid subscription (or such longer period as we may specify at the time of offer). After this period, standard pricing will apply, and we will notify you at least 30 days before any price change takes effect.

4.3 Beta feedback

We welcome and encourage feedback during the beta. Any feedback, suggestions, or ideas you provide become our property and may be used to improve the Service without obligation or compensation to you. This does not affect your rights in your personal data.

5. Subscriptions and Payment

5.1 Subscription plans

Following the beta period, the Service will be available on a monthly subscription basis at 10 per month (or such other price as we may publish at the time of your subscription). All prices are inclusive of VAT where applicable.

5.2 Free trial

New subscribers may be offered a 14-day free trial. At the end of the trial, your subscription will automatically convert to a paid monthly subscription unless you cancel before the trial ends. We will remind you before the trial expires.

5.3 Payment processing

Payments are processed by Stripe (stripe.com). By subscribing, you authorise Stripe to charge the payment method you provide on a recurring monthly basis. Your payment information is handled directly by Stripe and is not stored on BCKLE's servers. Stripe's terms of service and privacy policy apply to payment processing.

5.4 Automatic renewal

Your subscription renews automatically at the end of each monthly billing period. You can cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period -- you retain access until then.

5.5 Cancellation and your right to cancel

Statutory cancellation right. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a statutory right to cancel your subscription within 14 days of your initial purchase without giving a reason. To exercise this right, notify us at hello@bckle.app. If you have used the Service during this period, we may deduct a proportionate amount for the service received.

Ongoing cancellation. After the initial 14-day cancellation period, you may cancel your subscription at any time. Access continues until the end of the current paid billing period. No refund is given for partial months.

Cancellation by us. We may cancel your subscription and terminate your account if you breach these Terms, subject to giving you reasonable notice and an opportunity to remedy the breach where practicable. In the event of cancellation by us for reasons other than your breach, we will provide a pro-rata refund for any unused subscription period.

5.6 Price changes

We may change our subscription prices from time to time. We will notify you at least 30 days before any price increase takes effect. The new price will apply from your next billing period after the notice period. If you do not agree to the new price, you may cancel your subscription before the new price takes effect.

6. Your Data

6.1 Your data is yours

Your training data, health data, profile information, and chat history belong to you. We do not claim any ownership rights over your personal data. Our use of your data is governed by our Privacy Policy and these Terms.

6.2 Health data and consent

BCKLE processes health-related data including heart rate variability, sleep patterns, resting heart rate, and training load metrics. Under UK GDPR, this constitutes special category personal data (Article 9). We process this data on the basis of your explicit consent, which you provide during onboarding. You may withdraw consent at any time by disconnecting your wearable or deleting your account, though this will affect the Service's ability to function.

6.3 Data portability

You have the right to export your data at any time. The App provides a "Download my data" feature that generates a JSON export of your complete data including activities, readiness scores, sleep records, HRV readings, chat history, athlete notes, and profile information. A CSV alternative is also available. Export requests are processed as background jobs and the download link is emailed to you, typically within 24 hours.

6.4 Data deletion

You may request deletion of your account and all associated data at any time by using the account deletion feature in the App or by emailing hello@bckle.app. Upon receiving a deletion request:

6.5 Third-party data connections

By connecting your Garmin account (or any other supported wearable platform), you authorise BCKLE to receive your training, sleep, HRV, and activity data via that platform's API. This data is used solely to provide the Service. You can disconnect your wearable at any time through your account settings, which stops new data from being synced. Previously synced data remains until you request its deletion.

6.6 AI data processing

When you use the AI chat feature, a structured summary of your recent data (the "Athlete Context Snapshot") is sent to Anthropic's API to generate your response. This transmission is covered by a Data Processing Agreement between BCKLE and Anthropic, and Standard Contractual Clauses (SCCs) govern any international data transfer. Anthropic does not retain your data beyond the duration of the API call and does not use it for model training.

6.7 Anonymised data

With your separate, opt-in consent (not bundled with core service consent), we may use anonymised data -- meaning data that has been irreversibly stripped of all identifiers such that no individual can be identified -- for aggregate analysis to improve the Service. This consent is off by default and can be toggled in your account settings at any time.

7. Intellectual Property

7.1 Our intellectual property

All content, software, algorithms, branding, design, text, graphics, and other materials in the Service (excluding your personal data) are owned by BCKLE Ltd or our licensors and are protected by copyright, trademark, and other intellectual property laws. "BCKLE" and "Bckle Up" are trademarks of BCKLE Ltd. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

7.2 Your content

Any content you provide through the Service (such as chat messages, race entries, or notes) remains yours. By providing content, you grant BCKLE a non-exclusive, worldwide, royalty-free licence to use, process, and store that content solely for the purpose of providing the Service to you. This licence ends when you delete the content or your account.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Service ("Feedback"), you grant us an unrestricted, irrevocable, perpetual, royalty-free licence to use that Feedback for any purpose, including improving the Service. This does not apply to your personal data, which is always governed by our Privacy Policy.

During the beta and initial launch period, AI chat usage is limited to 20 messages per day per user. We will notify you when you approach or reach this limit. Usage limits may be adjusted as we scale the Service.

9. The Newsletter (Bckle Up)

9.1 Newsletter terms

Bckle Up is a free newsletter delivered via Substack. By subscribing, you consent to receiving emails from us. Substack's terms of service and privacy policy apply to the newsletter platform.

9.2 Newsletter content

Newsletter content is for general informational and educational purposes only. It is not personalised to your training data and does not constitute individual advice. The same health disclaimer in Section 3.2 applies to newsletter content.

9.3 Unsubscribing

You can unsubscribe from the Newsletter at any time using the link at the bottom of any email. Unsubscribing from the Newsletter does not affect your App subscription, and vice versa.

10. Limitation of Liability

10.1 What we do not limit or exclude

Nothing in these Terms excludes or limits our liability for:

Subject to Section 10.1, the Service is provided on an "as is" and "as available" basis. While we strive for accuracy and reliability, we do not warrant that:

We expressly disclaim liability for any adverse health outcomes, injuries, performance results, or other consequences arising from your reliance on information provided by the Service, including AI-generated responses, readiness assessments, fuelling guidance, and training recommendations.

You acknowledge that all decisions about your health, training, nutrition, and medical care are your own responsibility and should be made in consultation with qualified professionals.

This disclaimer does not limit our liability where our negligence directly causes death or personal injury (see Section 10.1(a)).

10.4 Cap on liability

Subject to Section 10.1, our total aggregate liability to you for all claims arising from or related to these Terms or your use of the Service shall not exceed the greater of: (a) the total amount you have paid to us in the 12 months immediately preceding the event giving rise to the claim; or (b) 100.

10.5 Indirect and consequential losses

Subject to Section 10.1, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, whether arising from contract, tort (including negligence), breach of statutory duty, or otherwise, even if we have been advised of the possibility of such damages.

10.6 Third-party services

We are not liable for the availability, accuracy, or performance of third-party services including Garmin Connect, Apple HealthKit, Stripe, Anthropic, or Substack. Your use of these services is subject to their respective terms and conditions.

10.7 Force majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemic, war, terrorism, riots, government action, power failure, internet or telecommunications failure, or third-party service outages.

11. Indemnification

You agree to indemnify and hold harmless BCKLE Ltd, its directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your misuse of the Service; or (c) your violation of any applicable law or third-party rights. This indemnity does not apply where the relevant claim arises from our negligence or breach of these Terms.

12. Suspension and Termination

12.1 Suspension by us

We may suspend your access to the Service, in whole or in part, if we reasonably believe that:

You may terminate your account at any time by using the account deletion feature or by emailing hello@bckle.app. Termination does not entitle you to a refund of any subscription fees already paid, except as set out in Section 5.5.

Upon termination, your right to use the Service ceases immediately (subject to any remaining paid subscription period if you cancel). We will process the deletion of your data in accordance with Section 6.4 and our Privacy Policy.

13. Dispute Resolution

13.1 Informal resolution

If you have a complaint or dispute regarding the Service, please contact us first at hello@bckle.app. We will endeavour to resolve any dispute informally within 30 days.

13.2 Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction to settle any dispute arising from these Terms, meaning you may also bring proceedings in the courts of the country in which you are resident if that country is within the UK.

13.3 Consumer rights preserved

Nothing in these Terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and UK GDPR.

14. General Provisions

14.1 Entire agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and BCKLE in relation to your use of the Service. They supersede all prior agreements, understandings, and representations.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

14.3 No waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

14.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor entity in connection with a merger, acquisition, or sale of substantially all of our assets, provided that the successor entity agrees to be bound by these Terms.

14.5 Third-party rights

These Terms do not confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999.
